Welcome to ANANSE.

These Terms of Use ("Terms") govern your access to and use of the ANANSE mobile application, official website, and any related services, content, software, updates, and features (collectively, the "Services") provided by BenCode Studio ("BenCode Studio," "we," "our," or "us").

By downloading, installing, accessing, or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

1. About ANANSE

ANANSE is a narrative puzzle-adventure game inspired by Akan folklore and African storytelling traditions. Through interactive gameplay, players explore stories, solve puzzles, discover wisdom, and experience original digital content created by BenCode Studio.

The Services may include mobile applications, the official website, game updates, downloadable content, cloud-based features, community features, customer support, promotional content, and additional services released in the future. Not every feature described within the Services may be available in every version, country, or platform.

2. Eligibility

You must comply with the laws applicable in your jurisdiction when using the Services. If you are under the age required to enter into a legally binding agreement in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf. Parents and guardians are responsible for supervising children's use of the Services.

3. License To Use The Services

Subject to your compliance with these Terms, BenCode Studio grants you a limited, personal, non-exclusive, non-transferable, revocable license to download, install, access, and play the Services solely for your personal, non-commercial entertainment. No ownership rights are transferred to you. All rights not expressly granted remain reserved by BenCode Studio.

4. Acceptable Use

You agree not to copy or redistribute the Services without permission; modify or reverse engineer the Services except where permitted by applicable law; circumvent security measures; attempt unauthorized access to systems or infrastructure; interfere with gameplay or network operations; use cheats, bots, automation, exploits, or unauthorized software; disrupt other players' experiences; upload malicious software; violate applicable laws or regulations; or use the Services for commercial exploitation without written authorization.

5. User Accounts

Some features may require an account. If accounts become available, you agree to provide accurate information, keep your credentials secure, notify us of unauthorized access, and remain responsible for activity occurring under your account. BenCode Studio may suspend or terminate accounts that violate these Terms.

6. Gameplay And Progress

Game mechanics, difficulty, scoring, rewards, achievements, progression systems, balancing, and content may change over time. BenCode Studio may modify or remove gameplay elements without prior notice to improve the overall player experience. Saved progress may not be compatible with every future update.

7. Virtual Items And Purchases

Certain versions of the Services may offer downloadable content, cosmetic items, premium content, virtual goods, digital currencies, expansion packs, or optional subscriptions. Where applicable, all purchases are licensed and not sold; virtual items have no real-world monetary value; virtual items cannot be exchanged for cash unless required by law; and purchases are generally non-refundable except where required by applicable law or the relevant app store's refund policies.

8. Intellectual Property

The Services, including all associated intellectual property, are owned by BenCode Studio or its licensors. This includes ANANSE, Web of Wisdom, game design, gameplay systems, artwork, characters, stories, dialogue, user interface, logos, icons, music, sound effects, animations, code, databases, documentation, and website content.

These materials are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you.

9. User-Generated Content

Certain Services may allow you to submit content, including feedback, suggestions, bug reports, reviews, community submissions, screenshots, fan creations, or other materials. You retain ownership of your original content.

By submitting content through the Services, you grant BenCode Studio a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, display, and distribute that content for operating, improving, promoting, and supporting the Services. You represent that you have the necessary rights to submit such content.

10. Third-Party Services

The Services may integrate with or link to third-party platforms, including Apple App Store, Google Play, Game Center, Google Play Games, Firebase, analytics providers, social media platforms, and payment processors. Your use of third-party services is governed by their respective terms and privacy policies. BenCode Studio is not responsible for third-party services.

11. Updates

We may release bug fixes, security updates, gameplay improvements, performance enhancements, new features, additional stories, new chapters, and additional languages. Certain updates may be required for continued use of the Services.

12. Availability

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. Maintenance, technical issues, service interruptions, or circumstances beyond our control may affect availability.

13. Beta And Experimental Features

From time to time we may release preview, beta, early access, or experimental features. These features may change without notice, may contain bugs, may be discontinued, and may not become permanent.

14. Privacy

Your use of the Services is also governed by our Privacy Policy and Cookie Policy. Please review them to understand how personal information, cookies, and similar technologies are collected, used, stored, and protected.

15. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, BenCode Studio disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the Services will always function without interruption, gameplay will be error-free, defects will always be corrected, or the Services will meet every user's expectations.

16. Limitation Of Liability

To the fullest extent permitted by law, BenCode Studio and its owners, employees, contractors, licensors, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Services.

Where liability cannot be excluded by law, our total liability shall be limited to the amount you paid for the Services during the twelve (12) months preceding the event giving rise to the claim, if any. Nothing in these Terms limits rights that cannot legally be excluded under applicable law.

17. Indemnification

You agree to indemnify and hold harmless BenCode Studio, its affiliates, officers, employees, contractors, licensors, and partners from claims, damages, liabilities, losses, costs, and expenses arising from your misuse of the Services, your violation of these Terms, your violation of applicable laws, or your infringement of another person's rights.

18. Suspension And Termination

We may suspend or terminate access to the Services if you violate these Terms, misuse the Services, threaten the security or integrity of the Services, or if we are required to do so by law. Termination does not affect rights or obligations that accrued before termination.

19. Changes To The Services

BenCode Studio may modify, replace, suspend, discontinue, or remove any portion of the Services at any time. We are not obligated to maintain any specific feature indefinitely.

20. Changes To These Terms

We may revise these Terms periodically. The updated version will be published through the official website or within the Services. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BenCode Studio is established, without regard to conflict of law principles. Where required by applicable law, consumers retain any mandatory legal rights available in their jurisdiction.

22. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms, together with the Privacy Policy and any additional legal notices incorporated by reference, constitute the entire agreement between you and BenCode Studio regarding the Services.
